The Supreme Judicial Court affirmed the judgment of the district court terminating Father’s parental rights pursuant to 22 Me. Rev. Stat. 4055(1)(A)(1)(a) and (B)(2)(a), (b)(i)-(ii), (iv). On appeal, Father argued that his counsel provided ineffective assistance and challenged the district court’s determination that termination was in the best interest of the child. The Supreme Judicial Court held (1) Father failed to present a prima facie case of attorney ineffectiveness; and (2) the evidence in the record supported the district court’s findings and discretionary determination that termination of Father's parental rights was in the best interest of the child.
